The Genuine Student (GS) Requirement: How to Avoid a Visa Refusal

The Crackdown on Visa Hopping

In early 2024, the Australian Government abolished the old 'Genuine Temporary Entrant' (GTE) requirement. They replaced it with the much stricter Genuine Student (GS) Requirement.

Why? Because thousands of people were using the student visa system to enter Australia and work full-time, rapidly hopping between cheap "ghost colleges" without ever intending to graduate.

The Core Change: Embracing PR Intentions

Under the old GTE system, if you admitted that you eventually wanted to apply for Permanent Residency (PR) in Australia, your visa would be instantly rejected. You had to pretend you were going back to your home country.

The new GS system acknowledges reality: It is now acceptable to want to migrate to Australia. However, you must prove that your primary reason for coming right now is to obtain a high-quality education, not just to work.

The Targeted Questions

Instead of writing a massive 300-word essay, the GS requirement forces you to answer specific, targeted questions on your visa application (maximum 150 words per answer):

  • Give details of your current circumstances: Ties to your home country, employment history, and financial stability.
  • Explain why you wish to study this course: The Trap: Do not just say "Because I like business." You must explain exactly why this specific Australian degree is vastly superior to the equivalent degree in your home country.
  • Explain how completing the course will benefit you: You must provide hard data. "Graduates of this Monash IT degree average a starting salary of $90,000 in my home country, compared to $40,000 for local graduates. This justifies the $120,000 tuition cost."
  • The Study Gap Red Flag

    If you graduated high school 5 years ago and have not studied since, the Department of Home Affairs will flag your application as extreme risk. You must provide airtight documentation (employment contracts, payslips, business registrations) proving exactly what you have been doing during that gap.
