TSS 482 vs 189 Visa: Should You Rely on Employer Sponsorship?

FastGPA Educational Team

The Points Dead End

You are working as a Marketing Specialist in Sydney. Your 485 Temporary Graduate Visa expires in 6 months. You calculate your points for the 189 Independent Visa: 70 Points.

Marketing is a highly saturated occupation. The cutoff is 85+. You are mathematically eliminated from getting independent PR.

Your only lifeline to stay in Australia is the TSS 482 (Temporary Skill Shortage) Employer Sponsored Visa.

What is the TSS 482 Visa?

This is a visa where your employer formally sponsors you to work for them.

  • The Requirement: You must have 2 years of full-time, post-qualification work experience in your occupation to even be eligible.
  • The Process: The employer must prove they could not find an Australian to do the job (Labour Market Testing), pay a massive Skilling Australians Fund (SAF) levy, and guarantee you a minimum salary (TSMIT, currently $73,150+).
  • The Dark Side of Employer Sponsorship

Unlike the 189 visa (which makes you a free permanent resident), the 482 visa ties your right to live in Australia directly to your boss.

    1. The Power Imbalance: You are indentured to the company. If your boss demands you work 60 hours a week without overtime, you cannot easily quit. If you resign or are fired, you have exactly 60 days to find a new employer willing to sponsor you, or you must leave the country.

    2. The Pathway to PR (186 TRT): The 482 is a temporary visa. To get actual Permanent Residency, you must work for that specific employer for 2 years on the 482 visa, after which they might sponsor you for the Subclass 186 Employer Nomination Scheme (PR). If the company goes bankrupt in month 23, your pathway to PR is destroyed.

    189 (Independent) vs 482 (Sponsored)

If you have the points (85+) for a 189 visa, pursue it relentlessly. It grants you absolute freedom. You can quit your job the day the visa is granted.

If you do not have the points, you must pivot to the 482 strategy immediately. This means prioritizing employers during your graduate job hunt who have a history of sponsoring international staff (e.g., Big 4 consulting, mid-tier engineering firms) rather than startups that cannot afford the SAF levy.
