Can You Apply for the Blue Card with a Startup Job?

You are a highly skilled software engineer from India. You applied for jobs in Berlin and received an incredible offer from an AI startup that is only 6 months old.

They offer you €60,000 a year. You are ecstatic because this easily clears the €45,300 standard EU Blue Card threshold. You take the contract to the Ausländerbehörde, expecting them to print your Blue Card immediately.

Instead, they launch a massive investigation into the startup.

Why?

The Federal Employment Agency (Bundesagentur für Arbeit)

When a German company hires a non-EU citizen for a standard work visa or a Blue Card, the immigration office often has to send the contract to the Bundesagentur für Arbeit (Federal Employment Agency - BA) for approval.

The BA's job is to protect the German labor market and prevent visa fraud.

While massive corporations like BMW or SAP are auto-approved, the BA is incredibly suspicious of brand new startups (companies that are less than 1-2 years old or have fewer than 10 employees).

The 'Fictitious Employment' Check

The government wants to ensure the startup is a real company, not just a fake shell company created by your cousin to illegally sponsor your visa.

If you apply for a Blue Card with a tiny startup, the BA will often demand:

  • A detailed business plan from the CEO.
  • Proof of venture capital funding or massive cash reserves.
  • Proof that the startup has already registered for a corporate tax number and is paying into the commercial register (Handelsregister).
  • If the startup is disorganized and cannot provide these documents quickly, your Blue Card application will be paused indefinitely.

    The IT Specialist Exception

    Startups love hiring self-taught programmers who do not have formal university degrees.

    Historically, you could NOT get a Blue Card without a Bachelor's degree. However, new German laws have created an IT Specialist Loophole.

    If you do not have a degree, but you have at least 3 years of professional IT experience, and the startup offers you a salary of at least €41,041.80 (As of 2024), you can now legally receive an EU Blue Card!

    This is a massive win for startup workers, but you still must endure the background checks on the company.
