The Dangerous Offer

You are an international student in Germany. You are running out of your 140 legal visa working days, but you still need money to pay rent.

You walk into a local restaurant or a construction site, and the boss makes you an offer: "I will pay you €12 an hour in pure cash at the end of every shift. No contract. No taxes. It won't count towards your visa days."

It sounds like the perfect solution. It is actually a one-way ticket to deportation.

What is Schwarzarbeit?

Working for cash without a registered contract and without paying taxes is called Schwarzarbeit (Black/Illicit Work).

In some countries, getting paid under the table at a restaurant is a minor offense. In Germany, Schwarzarbeit is treated as a severe financial crime. It is tax evasion and social security fraud.

The Zoll (Customs Enforcement)

The German government does not rely on local police to catch illegal workers. They use the Zollamt (Customs Enforcement) – specifically the FKS unit (Finanzkontrolle Schwarzarbeit).

The Zoll operates like a financial SWAT team. They routinely launch unannounced raids on restaurants, construction sites, and delivery hubs. They block the exits, demand everyone drop their tools, and force every worker to present their ID and residence permit.

What Happens When You Are Caught?

If you are caught washing dishes in a restaurant without a registered contract:

Arrest & Fines: You will be immediately detained. You can face personal fines of up to €5,000 for tax evasion and working illegally.

Immediate Visa Cancellation: The Zoll instantly notifies the Ausländerbehörde (Immigration Office). Working illegally is a fundamental violation of your 16b Student Visa. Your residence permit will be revoked.

Deportation and Bans: You will be ordered to leave the Schengen Area, and you will likely receive an entry ban preventing you from returning to Europe for several years.

Employer Punishment: The boss who hired you will face fines of up to €500,000 and potential prison time.

The Abuse Cycle

Beyond the legal risk, illegal employers are notorious for abusing international students. Because they know you are working illegally, they know you cannot go to the police. They will routinely force you to work 12-hour shifts, refuse to pay you your agreed wages, and threaten to report you to immigration if you complain.
