The Hidden Boss of German Immigration
When a non-EU citizen applies for a standard German work visa (Section 18a or 18b), they submit their passport and job contract to the German Embassy or the local Ausländerbehörde (Immigration Office).
Then, nothing happens for 6 to 8 weeks.
When you call to ask for an update, the clerk tells you: "Your file is with the Bundesagentur für Arbeit. We are waiting for their Zustimmung (approval)."

The Role of the Federal Employment Agency (BA)
The Bundesagentur für Arbeit (BA) is Germany's federal labor authority. Their primary legal mandate is to protect the German labor market and prevent wage dumping.
Before the immigration office can issue your visa, they must digitally send your employment contract to the BA for a deep, merciless audit.
The 'Priority Check' (Vorrangprüfung)
In the past, the BA conducted a highly restrictive Vorrangprüfung (Priority Check). They would check to see if a German citizen or an EU citizen could do the job instead of you. If they found an unemployed German with similar skills, they would reject your visa.
The Good News: Germany recently abolished the Priority Check for recognized skilled workers. You no longer have to prove that no German can do the job.
The 'Comparability Check' (Vergleichbarkeitsprüfung)
Today, the BA focuses entirely on the Comparability Check. They analyze your contract to ensure the German company is not exploiting you.
How to Bypass the BA Entirely
Waiting 8 weeks for the BA to audit your contract is agonizing. However, there is a legal way to bypass them completely.
The EU Blue Card. If you have a recognized university degree AND your job offer crosses the standard EU Blue Card salary threshold (€45,300 as of 2024), the immigration office does NOT have to ask the BA for permission.
The law assumes that if a company is paying you that much money, you are not being exploited. The immigration office can approve your visa internally, often reducing the processing time from 8 weeks down to 2 weeks.
