Can International Students Work as Freelancers in Germany?

The Uber and Fiverr Trap

You are a highly skilled international student in Germany. You know how to code, design logos, or edit videos. You realize you can make a lot more money taking freelance clients on Fiverr or Upwork than you can flipping burgers at a Minijob.

Or maybe you just want to download the Uber or Deliveroo app and drive a few hours a week as an independent contractor.

Stop immediately. You are about to violate federal immigration law.

The Visa Restriction

Take out your German Residence Permit (Aufenthaltstitel) and read the supplementary green sheet (Zusatzblatt).

It will explicitly state: "Selbstständige Tätigkeit nicht gestattet." (Self-employment is not permitted).

In Germany, there is a massive legal distinction between being an employee (Abhängige Beschäftigung) and being self-employed/freelance (Selbstständig / Freiberuflich).

Your student visa ONLY allows you to work as a dependent employee (meaning you have a boss, a formal employment contract, and the company pays half of your social taxes).

Examples of Illegal Freelance Work

If you do any of the following without special permission, you are working illegally:

  • Taking clients on Upwork, Fiverr, or Toptal.
  • Driving for Uber or Amazon Flex (where you are legally classified as an independent contractor).
  • Tutoring high school students for cash and printing your own invoices.
  • Selling handmade crafts on Etsy for profit.
  • What Happens if You Get Caught?

    The Finanzamt (Tax Office) is highly efficient. If they see regular, untaxed wire transfers from "Upwork" hitting your checking account, their automated systems will flag you.

    If the Ausländerbehörde (Immigration Office) finds out you are operating as a freelancer on a student visa, they consider it a severe breach of your residency conditions.

  • You will face massive fines for tax evasion.
  • Your student visa will be cancelled.
  • You will be issued a deportation order.
  • The Rare Exception

    If you truly have a highly lucrative freelance opportunity, you can book an appointment with the immigration office and formally request a Special Exception (Sondergenehmigung).

    You must bring a detailed business plan and prove that your freelance work will not interfere with your university studies. The officers almost always reject these requests, but it is the only legal way to try.
