Working During the Semester Break: The 40-Hour Exception

If you hold a Werkstudent contract, you are legally forbidden from working more than 20 hours a week. If you cross 21 hours, you lose your tax-free student status and get hit with massive social security deductions.

But living in Munich or Berlin is expensive. Working only 20 hours a week often leaves you with barely enough cash to survive.

How do international students actually build their savings? They exploit the Vorlesungsfreie Zeit (Semester Break) Exception.

The 40-Hour Loophole

German universities have massive holidays. The winter break usually lasts from mid-February to mid-April, and the summer break lasts from August to October.

During these exact dates (the lecture-free period), the government acknowledges that you have no classes to attend.

Therefore, the 20-hour rule is completely paused.

You are legally allowed to ask your employer to increase your hours to 40 hours a week (full-time) for the entire duration of the break.

The Tax Magic Remains

Here is the most incredible part of the rule:

Even though you are working 40 hours a week and earning massive full-time paychecks (often €2,500+ a month), you retain your Werkstudent tax privilege.

You still do NOT have to pay the heavy Health, Unemployment, or Nursing Care taxes. You only pay the standard 9.3% pension tax. This allows you to stack a massive amount of cash over a 2-month period to build a buffer for the rest of the year.

The 26-Week Legal Limit

You cannot abuse this system forever.

The law states you can only exceed the 20-hour limit for a maximum of 26 weeks (182 days) per calendar year.

Since the combined university holidays in Germany are usually only 12 to 14 weeks long, you will naturally stay well below this limit if you only work full-time during the official breaks.

Warning: Your Visa 140-Day Limit Still Applies

Do not confuse the Tax Office rules with the Immigration Office rules.

Working 40 hours a week protects your tax status, but it burns your visa days incredibly fast.

  • Working full-time for 2 months straight will burn roughly 45 Full Days off your 140-day visa limit.
  • You must ensure you have enough visa days left to cover your part-time work during the regular semester.
