Failed the Course? How Retaking a Module Invalidates Your Graduate Visa

You are studying a 1-year Master's in Finance. The course officially ends in September. Your Student Visa expires in January. In October, the results are released. You passed all your exams, but you failed your final 10,000-word dissertation.

The university is forgiving. They say, "Don't worry, you can resit the dissertation. Submit the new version in December. We will give you the final grade in February."

You agree. But you have just walked into a fatal immigration trap. You will not get your Graduate Visa. You will be forced to leave the UK.

The Timeline Collapse

To get the Graduate Route Visa (PSW), you must apply from INSIDE the UK while holding a VALID Student Visa, AFTER the university has notified the Home Office that you successfully completed the course.

Let's look at your timeline:

  • Your Student Visa expires in January.
  • The university won't grade your resit and notify the Home Office until February.
  • By February, your visa has expired. You are an illegal overstayer.
  • You cannot apply for the Graduate Visa in January because the university hasn't notified UKVI yet (an instant refusal). You cannot wait until February because your visa will have expired.

    The "Extension" Myth

    Many students assume they can just "extend" their Student Visa for a few months to cover the resit period. The Home Office usually refuses this.

    You can generally only extend a Student Visa from inside the UK if you are starting a new course at a higher academic level (e.g., moving from Master's to PhD), or if the university formally requires your physical presence for the resit (which they rarely do for a dissertation).

    Usually, the university will tell you to go back to your home country, write the dissertation there, and submit it online.

    The Fatal Blow

    If you go back to India or China to write the resit, your Student Visa expires. When you finally pass in February, you are sitting in your home country. You cannot apply for the Graduate Route Visa from outside the UK. Because you left the country, you permanently lost your right to the 2-year PSW.

    The Strategy: Do not fail. It sounds harsh, but failing a module in the UK is not an academic issue; it is a £30,000 immigration disaster. If you feel you are struggling with your dissertation in July, hire a tutor, spend 18 hours a day in the library, and do whatever it legally takes to pass the first time. The immigration system has zero mercy for academic resits.
