New Entrant Rate: The Loophole That Cuts Salary Thresholds to £30,960
The HR Negotiation
You are sitting in a final interview for a Data Analyst role in Birmingham. The salary budget for the role is £32,000. The HR Director looks at you sadly. "We would love to hire you. But you need visa sponsorship. The government just raised the minimum salary to £38,700. We simply don't have the budget to pay a junior analyst that much."
The interview is over. You are about to lose the job. This is the moment you must pull out your trump card.
You say: "Actually, because I am switching from a Student/Graduate Visa, I qualify as a New Entrant. By law, you only have to pay me £30,960. Your budget of £32,000 is perfectly legal."
The HR Director is stunned. They check with their lawyers. You are right. You get the job.
The Mathematics of the New Entrant Rule
To stop the total collapse of the UK graduate market, the Home Office allows "New Entrants" to be sponsored at a 30% discount on the standard going rate, or a minimum floor of £30,960 (whichever is higher). You qualify automatically if you are switching from a Student Visa or a Graduate Route Visa. (You also qualify if you are under 26, but the visa switch is the most common route).
How It Works in Practice
Let's say you are hired as a Mechanical Engineer (Standard Occupation Code 2122).If you applied without the New Entrant discount, they would have to pay you the full £39,000. You just saved the company £8,000 a year in payroll, saving your job offer.
The Expiry Date
This discount is a temporary bridge, not a permanent solution. You can only be sponsored as a New Entrant for a maximum of 4 years (including any time spent on a Graduate Visa). If you are on a Graduate Visa for 2 years, and then switch to a Skilled Worker Visa, you can only use the New Entrant discount for 2 more years. At the end of those 2 years, you must secure a promotion or a pay rise that pushes your salary above the full £38,700 threshold, or your visa cannot be renewed.
The Strategy: You cannot expect local UK employers to know the intricacies of immigration law. They just read the headlines about £38,700. You must be your own immigration lawyer. Bring a printed copy of the Home Office "New Entrant" guidance to your final interviews. Show them the math. Prove that hiring you is legally viable.
