Capped vs Uncapped Resits: How to Legally Force an Uncapped Attempt

The 40% Prison

As we established, if you fail a module in the UK, your summer resit is permanently capped at 40% (The minimum pass mark).

If the module is worth 40 credits (like a dissertation), a capped 40% will mathematically destroy your chances of getting a 2:1 overall. It acts as an anchor, dragging your WAM into the low 2:2 or 3rd Class territory.

However, there is a legal mechanism to force the university to remove the cap, allowing you to take the exam in August and score a full, unpenalized 100%.

This is known as a "First-Attempt Resit" (Uncapped).

The Bureaucracy of the Uncapped Resit

The university will not offer you an uncapped resit out of kindness. You must trigger a specific bureaucratic procedure: Mitigating Circumstances (MC).

To get an uncapped resit, you must prove to the MC Panel that your failure in May was directly caused by an unforeseeable, severe external event.

The Timeline is Critical: You cannot wait until you fail the exam to claim MC. If you take the exam in May, get a 30%, and then in July say, "I was sick during the exam," the panel will reject your claim. They will say: "If you were sick, you shouldn't have taken the exam. By sitting the exam, you declared yourself 'Fit to Sit'."

How to Secure the Uncapped Resit

If you are approaching an exam period and you are dealing with a severe issue (medical, psychological, or a family emergency), you must execute this sequence perfectly:

1. Secure Independent Evidence You need third-party, professional proof. A doctor's note, a hospital admission record, or a letter from a university counselor. It must clearly state dates that align with your exam period.

2. Do NOT Take the Exam If the evidence proves you are severely unwell, do not attempt the exam. Deliberately skip it. (Check your specific university rules, but usually, sitting the exam voids your right to claim MC).

3. Submit the MC Form Immediately Submit the form with the evidence before the exam date, or within the strict 5-day window after the exam.

The Exam Board Decision

If your MC claim is approved, the Exam Board will record your May exam as a "Voided Attempt." They will officially invite you to take the exam in the August resit period.

Because your May attempt was voided, the August exam legally becomes your First Attempt. Therefore, the 40% penalty cap cannot be applied. If you score an 85% in August, that 85% goes directly onto your final transcript.

The Strategy: The UK university system heavily penalizes students who try to "power through" illness or personal crises. If you are genuinely incapable of performing to your standard in May, the most mathematically optimal move is to legally defer the exam to August using the Mitigating Circumstances procedure, ensuring your WAM is protected by an uncapped attempt.
